The Department of Health and Mental Hygiene is the state government office in charge of providing mental health treatment services to the citizens of Maryland. Judges, attorneys and people in need of help have become frustrated with the Department’s failure to provide psychological services as required by the Constitution. Maryland law requires that people charged with criminal offenses who are ordered to receive psychological evaluations and treatment must be removed from jail to a psychiatric facility. The Department of Health and Mental Hygiene is currently unable to comply with the requirements of Maryland law. Judges have been forced to file contempt of court proceedings to force the Department to help those in need. Lawmakers say that addressing mental health treatment is required by the Constitution and Maryland law. An incarcerated person may be entitled to release from jail if the Department has not complied with a court order for evaluation.
